Qwest Rides Ng – Terms and Conditions
These Terms and Conditions apply to your use of the Qwest Rides Ng platform (the “Platform”), including our mobile apps, websites, and related services (collectively, the “Services”). Qwest Rides Ng (“Qwest”, “we”, “our”, or “us”) operates as a technology platform that connects Riders seeking transportation with independent Drivers who provide transportation.
PART A: RIDER TERMS AND CONDITIONS
1. Eligibility
You must be at least 16 years old to use the Services.
You agree to provide accurate information during account registration and keep it updated.
2. Use of Services
You may request rides through the app. Once a Driver accepts, a contract is formed directly between you and the Driver.
You agree to treat Drivers respectfully, comply with traffic and safety rules, and avoid unlawful conduct.
3. Payments
Fares are displayed before or during the ride and include time, distance, and applicable charges.
Payments must be made through the app’s payment system or other approved methods.
By using the Services, you authorize Qwest to charge your selected payment method.
4. Cancellations & Refunds
If you cancel before a Driver is dispatched, no fee applies.
If you cancel after a Driver is en route, a cancellation fee may be charged.
Refunds will only be issued in line with Qwest’s Refund Policy.
5. Safety
You must wear a seat belt during the ride.
You may not carry weapons, illegal substances, or behave abusively toward Drivers.
If you feel unsafe, you should immediately end the trip and report the incident via the app.
6. Liability
Qwest is not a transportation provider. The Driver is solely responsible for the ride.
Qwest shall not be liable for accidents, injuries, or damages that occur during the trip.
PART B: DRIVER TERMS AND CONDITIONS
1. Eligibility
You must be at least 18 years old.
You must hold a valid Nigerian driver’s license, vehicle documents, and National Identification Number (NIN).
Your vehicle must be roadworthy, insured, and compliant with Nigerian laws and Abuja transport regulations.
2. Use of Services
You agree to accept and complete rides in a safe, professional, and lawful manner.
You are an independent contractor, not an employee of Qwest. Nothing in these Terms creates an employment relationship.
You must not misuse Rider data or use the Platform for fraudulent purposes.
3. Earnings & Service Fee
Fares are set by Qwest’s system and communicated through the app.
You will receive payments net of Qwest’s service fee/commission.
Qwest reserves the right to adjust fares or service fees with prior notice.
4. Safety & Conduct
You must comply with all traffic laws in Nigeria.
Seat belts must be provided and worn by all occupants.
Reckless driving, harassment, or carrying illegal substances is strictly prohibited.
You are required to maintain proper insurance for your vehicle.
5. Vehicle Standards
Your vehicle must be well-maintained, clean, and meet Abuja transport authority requirements.
Qwest may suspend or deactivate Drivers who fail to meet vehicle or service standards.
6. Liability & Insurance
You are responsible for your vehicle and passengers during trips.
Qwest does not provide vehicle or personal accident insurance.
Drivers must hold valid motor insurance as required under Nigerian law.
PART C: GENERAL TERMS (APPLICABLE TO RIDERS & DRIVERS)
1. Account Suspension
Qwest may suspend or terminate your account at its sole discretion if:
You violate these Terms,
You engage in unlawful activity, or
You pose a risk to safety.
2. Limitation of Liability
To the extent permitted by Nigerian law, Qwest is not liable for indirect, incidental, or consequential damages, including lost profits.
3. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be subject to the courts of Abuja, Nigeria.
4. Amendments
Qwest may update these Terms periodically. Updated Terms will be posted on the Platform, and continued use of Services constitutes acceptance.
